Andrew Chamberlin and Alex Hagan Obtain Protective Order on Behalf of French Client to Avoid International Discovery Conflict

In March 2018, Ellis & Winters attorneys Andrew Chamberlin and Alex Hagan obtained an order in the United States District Court for the District of Arizona protecting a French client from discovery obligations that conflicted with the laws of its home country-including and especially the French Blocking Statute. The client-a French manufacturing corporation defending against product liability claims-sought a protective order requiring the plaintiff to obtain discovery under the Hague Evidence Convention instead of traditional discovery methods available under the Federal Rules of Civil Procedure. Chamberlin and Hagan successfully argued that discovery should take place under the supervision of a French discovery commissioner pursuant to Chapter II of the Hague Evidence Convention to avoid exposing the client to civil and criminal sanctions under French law. The court’s order represents a key victory for international litigants faced with conflicting obligations under United States discovery rules and foreign data protection and blocking statutes.

Welcome New Members…

Heidi Goebel and Mark Anderson of Goebel Anderson, P.C. in Salt Lake City, Utah who joined Eagle in January 2018. Heidi and Mark are civil litigators who met years ago while practicing at a prior firm. Heidi’s legal experience primarily focused on product liability and commercial and securities litigation, while Mark was mostly involved in representing insurance companies and litigating insurance contract and personal injury claims. They soon discovered that they share a common perspective on how a law firm should be managed, and how it should approach the goals of providing service and value to its clients. Over time, they decided to form their own law firm, and to apply their experience to provide excellent legal work and outstanding client service in an enjoyable work environment. This is how the law firm of Goebel Anderson PC came to be.

Jean Faure of Faure Holden Attorneys at Law, P.C. in Great Falls, Montana who joined Eagle in March 2018. Faure Holden is an AV rated law firm with experienced trial attorneys. The firm’s principal office is in Great Falls but their practice takes them throughout the State of Montana appearing in all Federal and State Courts and Agencies in Montana, the United States Court of Appeals for the Ninth Circuit, and the Supreme Court of the United States. The firm’s practice includes all aspects of labor and employment law (management), employment litigation defense, school law, insurance coverage litigation, commercial and business litigation, premises and products liability, personal injury litigation, oil and gas litigation, estate and trust litigation and criminal defense. Since 2009, Jean has been selected for inclusion in the Mountain States Super Lawyers in the field of employment litigation defense, an honor given only to 5% of Montana lawyers. In 2015, Super Lawyers selected Jean to the Top 100 lawyers. Jean also has been named on an annual basis in the Chambers USA Guide in Labor & Employment Law since 2011. Jean was invited to join the Federation of Defense and Corporate Counsel and the Litigation Counsel of America in 2015. James C. Greene Company is approaching its 1-year anniversary at our new location in mid-town Raleigh at 333 E. Six Forks Road after having lodged the prior 61 years in downtown Raleigh at our 323 W. Morgan St. building. It is refreshing to be on the tenant side of the ledger as opposed to the landlord.
